Your gardener has killed your tree. The tree is girdled - that means the bark is missing all the way around and there is no longer a way for nutrients and water to get to the top of the tree. It may grow from the roots but the tree that grows will be whatever rootstock the tree was. Your gardener owes you a new tree.
